1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and Ghost Systems ("we," "our," or "us"), operating as Alertra. By accessing or using the Alertra website at alertra.app, the Alertra mobile application, and any related services (collectively, the "Service"), you agree to be bound by these Terms.
If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any modifications constitutes your acceptance of the revised Terms.
2. Description of Service
Alertra is a disaster monitoring and alerting platform developed by Ghost Systems. The Service provides:
- Real-time earthquake activity monitoring based on data from the U.S. Geological Survey (USGS).
- Localized threat assessments and risk scores derived from proprietary algorithms applied to public seismic data.
- Historical earthquake trend analysis and data visualization.
- Push notification alerts for seismic events near user-specified locations.
- General earthquake preparedness and safety information.
3. Important Disclaimers
⚠️ Not an Official Warning System
Alertra is not an official government emergency warning system. The Service is intended for informational and educational purposes only. Do not rely solely on Alertra for life-safety decisions. Always follow official guidance from local emergency management agencies, the USGS, FEMA, and your state or county emergency services.
3.1 Data Accuracy
The earthquake data displayed on the Service is sourced from the USGS and other public agencies. While we strive to present this data accurately and promptly, we make no guarantees regarding:
- The completeness, accuracy, or timeliness of earthquake data.
- The accuracy of threat scores, risk assessments, or magnitude estimates.
- The continuous, uninterrupted availability of the Service.
Earthquake data is inherently preliminary and subject to revision by the USGS. Magnitude, location, and depth values may be updated after initial reporting.
3.2 No Professional Advice
The information provided through the Service does not constitute professional geological, seismological, engineering, or emergency management advice. The safety tips and preparedness information are general guidelines and may not account for your specific location, building structure, or circumstances.
3.3 Alert Delivery
Push notification alerts are delivered on a best-effort basis. Alert delivery depends on factors outside our control, including your device settings, network connectivity, operating system restrictions, and third-party push notification infrastructure. We do not guarantee that alerts will be delivered within any specific timeframe or at all.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable federal, state, local, or international law or regulation.
- Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service.
- Use automated scripts, bots, scrapers, or similar tools to access the Service, except for legitimate search engine crawlers.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service for commercial purposes without our express written permission.
- Misrepresent Alertra data as official government warnings or emergency alerts.
- Use the Service to generate false, misleading, or alarmist reports about seismic activity.
5. Intellectual Property
The Service and its entire contents, features, and functionality — including but not limited to the Alertra name, logo, risk scoring algorithms, threat assessment methodology, user interface design, text, graphics, and software — are owned by Ghost Systems and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
The underlying earthquake data sourced from the USGS is in the public domain. Our proprietary risk scores, threat assessments, visualizations, and analysis derived from that data are our intellectual property.
6. Third-Party Data and Links
The Service relies on data from third-party sources, including:
- U.S. Geological Survey (USGS): Real-time and historical earthquake data via the USGS Earthquake Hazards Program API.
- National Oceanic and Atmospheric Administration (NOAA): Weather and environmental data.
- National Weather Service (NWS): Forecast and severe weather data.
- NASA FIRMS: Active fire and wildfire data from satellite imagery.
We are not affiliated with, endorsed by, or officially connected to any of these agencies. Their data is used in accordance with their respective public use policies. The accuracy and availability of third-party data is beyond our control.
The Service may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GHOST SYSTEMS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:
- Loss of profits, data, use, goodwill, or other intangible losses.
- Personal injury or property damage resulting from your reliance on the Service.
- Failure to receive an earthquake alert or notification.
- Inaccuracies in earthquake data, risk scores, or threat assessments.
- Any interruption, suspension, or termination of the Service.
- Any unauthorized access to or alteration of your data.
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, THAT ANY ERRORS OR DEFECTS WILL BE CORRECTED, THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS.
9. Assumption of Risk
You acknowledge that earthquakes are inherently dangerous and unpredictable natural events. By using the Service, you acknowledge and agree that:
- The Service is a supplementary information tool and not a substitute for official emergency systems.
- You are solely responsible for your own safety and the safety of those in your care during a seismic event.
- You assume all risk associated with decisions made based on information provided by the Service.
10. Indemnification
You agree to defend, indemnify, and hold harmless Ghost Systems, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any third-party right, including any intellectual property or privacy right.
- Any claim that your use of the Service caused damage to a third party.
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice or liability. Upon termination, your right to use the Service will immediately cease.
All provisions of these Terms that by their nature should survive termination shall survive, including without limitation: intellectual property provisions, warranty disclaimers, indemnification obligations, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Los Angeles County, California, and you consent to personal jurisdiction and venue therein.
13. Severability
If any provision of these Terms is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ghost Systems regarding your use of the Service, and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral.
